My Signature
PROCESS
01. COMPLIMENTARY DISCOVERY CALL
We'll begin with a complimentary discovery call to discuss your brandβs trademark protection needs and the best path forward.
02. COMPREHENSIVE CLEARANCE SEARCH
Next, I conduct a clearance search to assess the availability and viability of your mark, followed by a written risk assessment and a strategy call to walk through the results together.
03. APPLICATION PREPARATION & FILING
Once we've confirmed the right path forward, I prepare and file your trademark application with the USPTO, ensuring it's structured strategically to minimize delays and maximize your chances of approval.
04. ONGOING COMMUNICATION & SUPPORT
I keep you informed with email updates throughout the initial examination process and respond to office actions that may arise along the way (based on the scope of support included in your selected package), so you always know where things stand and what to expect next.
05. FINAL APPROVAL
Once your application clears examination, your mark moves into the public opposition period. If no oppositions arise, it proceeds to registration and final approval, giving you the federally protected trademark your brand deserves!
Frequently Asked QUESTIONS
-
A trademark is the legal protection you secure for a brand element β like your business name, logo, or tagline β once itβs registered with the U.S. Patent and Trademark Office. Federal trademark registration gives you exclusive rights to use that element in connection with your goods or services, helps customers recognize and trust your brand, and prevents competitors from using confusingly similar branding.
-
The trademark registration process usually takes 12β18 months, depending on how thorough your application is and whether you face office actions or oppositions. Because the process is lengthy and deadlines are strict, itβs critical that your application is prepared thoroughly and correctly from the start. Even small mistakes or omissions can cause costly delays or jeopardize approval β which is why many business owners choose to work with an attorney to strengthen their application and avoid setbacks.
-
A trademark can last indefinitely β but only if itβs properly maintained. That means you must continue using it consistently in connection with the goods or services you registered, and you must meet the USPTOβs maintenance requirements by filing specific renewal documents at regular intervals (between years 5β6, at year 10, and every 10 years after that). If you stop using the mark or miss these deadlines, your registration can be canceled, and your rights could be lost.
-
Yes. Forming an LLC, S-Corp, or other type of business entity can protect you legally by separating your personal and business liabilities, but it does not give you exclusive rights to your business name. Only a trademark grants you the ability to stop others in your industry from using the same or a confusingly similar name, logo, or tagline.
-
Trademarks secure brand elements (names, logos, taglines) that distinguish your goods or services in the market. Copyrights secure original creative works (content, art, written copy, software). Both fall under the umbrella of intellectual property, but they each protect different types of assets β so knowing what type of protection applies to which pieces of your brand is key.
-
If your trademark or copyright is registered, you can enforce your rights with far greater remedies β often starting with a cease-and-desist letter, and escalating to takedowns or litigation if necessary. Without registration, your rights are weaker and harder (and more expensive) to enforce.
-
Yes! Trademarks are a matter of Federal law, so I work with clients needing legal support with trademarks nationwide, and even international brands that wish to secure trademark protection in the U.S.

It can be tempting to DIY your legal needs, but even small mistakes can have big consequences. With trademarks, the support of an attorney is especially crucial, as a poorly prepared application could mean rejection, cancellation, or limits on your protection. Having a lawyer ensures your legal foundation is strong, strategic, and built to safeguard your business long-term.
